Terms of Service

These terms govern use of Rudy Route Picker (the "App"), operated by iNovaLynx (KvK 42145387) ("we", "us"), whose full registered details are at the foot of this page. Contact: [email protected].
1. The service
Rudy Route Picker plans and navigates motorcycle routes, using your device's location and, where you grant it, motion/orientation sensors for lean-angle analysis. Route calculation runs on a routing server we operate ourselves for the Netherlands, Belgium, Luxembourg and Germany, and falls back to a third-party service beyond that area. Map tiles and much of the underlying road data come from third parties. Availability and accuracy are not guaranteed.
2. Accounts
Signing in with Google identifies you to us for the purpose of managing your subscription. It does not grant the App any additional device permissions — location and motion access are requested and controlled separately by your browser or device, per Section 5 of the Privacy Policy.
3. Subscriptions
The App offers a free tier and a paid annual "Premium" tier. Premium is billed annually in advance. Payments are processed by Stripe; we sell the subscription to you directly, and Stripe acts as our payment processor rather than as the seller.
- Prices are shown in EUR and include any VAT due — the amount shown is the amount charged, with nothing added at checkout.
- Subscriptions renew automatically unless cancelled before the renewal date.
- You can cancel at any time from your payment processor's customer portal; access continues until the end of the paid period.
- As a digital service that begins immediately at your request, EU consumers acknowledge that the 14-day right of withdrawal does not apply once the subscription has started, to the extent permitted by applicable law.
4. What the free tier costs
The free tier is paid for with road data rather than money. Using it, your finished rides contribute anonymous road measurements — corner speeds, lean angles and surface roughness tied to places on the road — which are what make the routes it suggests good. This is a term of the free tier and cannot be switched off while you are on it.
Those measurements carry no link to your account and no record of the route you rode, and cannot be traced back to you. Pro subscribers can switch contribution off entirely, and their contributions remain linked to their account so that they can be deleted on request. Permission to share road data onward with other organisations is separate, optional on every tier, and never a condition of using the App. The detail is in the Privacy Policy.
5. Discount codes
Discount codes, where issued, are single-use unless stated otherwise, may be withdrawn at any time, and have no cash value.
6. Acceptable use
The App is a planning and navigation aid, not a substitute for safe riding judgement. Do not interact with the App while riding. Do not use the App to violate traffic law.
7. You are the rider, and you remain responsible
You operate the motorcycle. The App suggests a route; every decision about how to ride it is yours, and nothing the App displays relieves you of that. In particular:
- What you can see always wins. Road signs, signals, markings, barriers and the instructions of police or road workers take precedence over anything the App shows you, without exception. If the App and the road disagree, the road is right.
- Speed limits shown in the App are estimates. They come from map data that may be wrong, missing, or out of date, and they do not account for temporary limits, weather, or conditions. The sign at the roadside is the law; the App is not.
- Speeding fines and traffic penalties are yours. You remain solely responsible for obeying traffic law and for any fine, penalty, points, prosecution or other consequence of not doing so — including where the App displayed a limit or a camera location that turned out to be wrong, or displayed none at all.
- You decide whether a road is safe to ride. The App does not assess whether a route passes through an area that is unsafe, unlit, unsuitable for your motorcycle or your experience, or inadvisable at the time of day. If a road looks wrong to you, do not ride it.
- Check your own fitness to ride and your machine. The App knows nothing about your tyres, brakes, fuel, fatigue or licence.
8. What may be inaccurate
The App is built on third-party, governmental, community and sensor-derived data. All of it can be wrong, incomplete or out of date, and some of it routinely is. This includes, without limitation:
- Routes, distances, arrival times and turn-by-turn instructions.
- Speed camera locations, their type, the direction they face, and the speed they enforce — including cameras that exist but are not shown, and cameras shown that are no longer there.
- Road closures and roadworks, whether from official feeds or reported by other riders, and whether a road reported shut is in fact shut or open.
- Speed limits, road surface, road class, and whether a road is paved.
- Lean angle, road roughness and other sensor-derived figures, which are estimates.
- Weather, daylight and sunset times.
- Fuel stations, their brand, their fuel grades, and opening hours.
The App is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or available at any particular time.
9. Liability
To the fullest extent permitted by law, we are not liable for any loss, damage, injury, cost or claim arising out of or connected with your use of the App. This includes, without limitation:
- Any accident, collision, injury or damage to persons, motorcycles or property.
- Any fine, penalty, prosecution or other consequence of a traffic infringement, including speeding.
- Any consequence of the App routing you through an area you consider dangerous, unsuitable or unpleasant.
- Any consequence of inaccurate road signs, speed limits, camera locations, camera speeds, closures or any other data described in Section 8.
- Getting lost, delayed, running out of fuel, or being unable to complete a ride.
- Lost data, lost rides, or the App being unavailable.
Where we are nevertheless found liable, our total liability to you for all claims taken together is limited to the amount you actually paid us for the App in the twelve months before the event giving rise to the claim. If you use the App on the free tier, that amount is zero.
What this section does not exclude. Nothing in these terms excludes or limits our liability for death or personal injury caused by our own intent or gross negligence (opzet of bewuste roekeloosheid), for fraud, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, your mandatory statutory rights under the law of your country of residence are unaffected by these terms, and nothing here is intended to reduce them. Should any part of this section be held unenforceable, the remainder continues to apply.
10. Device permissions
The App asks your device for two permissions. Both are requested by your phone or browser, not by us, and you can withdraw either at any time in your device settings — the App keeps working without them, with the features that depend on them switched off.
- Location — used to plan a route from where you actually are, to follow you along it as you ride, and to show your position on the map. Without it you can still plan routes by placing a starting point by hand, but turn-by-turn navigation is unavailable.
- Motion & orientation — used to estimate lean angle and to time laps in Track mode. Without it, routing and navigation are unaffected; only lean and lap timing stop working.
What happens to any ride data these produce is covered in the Privacy Policy, and the choices are yours to change under Settings → Your ride data.
11. Changes
We may update these terms from time to time; continued use after a change constitutes acceptance of the revised terms.
12. Governing law
These terms are governed by the law of the Netherlands, and disputes will be brought before the competent court in the Netherlands. If you are a consumer resident elsewhere in the EU, this does not deprive you of the protection of any mandatory provisions of the law of your own country, nor of the right to bring proceedings there.
Attribution
Route and map data comes from OpenStreetMap contributors, licensed under the Open Database License. Map tiles are served by OpenFreeMap, address search by Photon, and routing outside the Netherlands, Belgium, Luxembourg and Germany by Geoapify. Routing within those four countries runs on our own servers.
